Overtime Pay Formulas
Federal FLSA (Weekly)
Regular Pay = rate × min(hours, 40)
OT Pay = rate × 1.5 × OT hours
Total = Regular Pay + OT PayHours over 40 in a 7-day workweek are paid at 1.5× the regular rate. Overtime is calculated weekly, not daily.
California (Daily + Weekly)
Regular = min(hrs, 8)/day × rate
Daily OT = hrs 8–12/day × 1.5×
Double Time = hrs >12/day × 2×California also applies weekly OT for hours over 40 not already captured by daily rules. Employees receive the greater of daily or weekly overtime pay.

Overtime pay is additional compensation required by the Fair Labor Standards Act (FLSA) for hours worked beyond 40 in a workweek. The federal minimum overtime rate is 1.5 times (time and a half) the regular hourly rate.
Non-exempt employees under the FLSA qualify for overtime. Most hourly workers qualify. Salaried employees earning less than $684/week ($35,568/year) as of 2024 are also typically entitled to overtime. Executives, administrators, and professionals meeting salary and duties tests may be exempt.

Federal law (FLSA) calculates overtime on a weekly basis — hours over 40 in a 7-day workweek. California requires both daily overtime (over 8 hrs/day at 1.5x, over 12 hrs at 2x) AND weekly overtime (over 40 hrs at 1.5x). An employee gets whichever method results in more overtime pay.
Salaried employees earning below the FLSA threshold ($684/week/$35,568/year) must receive overtime for hours over 40/week. Highly compensated employees earning over $107,432/year are typically exempt. Always check your state's rules, as some states have higher thresholds.
